Local Small Claims Practices

There are some local policies or practices that you should be aware of, in addition to the small claims handbook.  This list may not be an all-inclusive list of requirements you may need for small claims court in your location. You may wish to contact the court you plan to file in to make sure you have all the information you need.

Interpreter Information
Interpreters services are provided by the court for all parties in small claims cases. Please notify the court as soon as possible if you require the services of an interpreter for your hearing, or contact the Managing Interpreter in the district in which your case was filed.

Small claims trials are held on the 2nd and 4th Monday of every month at 8:30 a.m.  Be at least fifteen minutes early to get through security and be on time to court.  Being late may result in a dismissal or a default judgment being entered against you.

All parties will be ordered to mediate on the trial date.  Volunteer attorneys will be present to act as mediators.

If a case is not resolved through mediation, a trial will be held.  Parties are expected to be prepared to present evidence through testimony of themselves, witnesses, or documentation to support their claim or defense.  All parties must read the “small claims handbook” that can be accessed via the link above to ensure they understand how to prepare and present their case.

Requests for a continuance must be in writing and filed before the trial date.  All correspondence to the Court must be copied to the other party and the moving party shall certify that they have done so on the face of the correspondence.

Failure to appear to court on time on the appropriate date may result in a default judgment or a dismissal of the claim absent a showing of good cause.

8 Ft. Collins / Loveland N/A Y

Small claims cases may be filed in Larimer County at either the Larimer County Justice Center, at 201 LaPorte Avenue, Fort Collins, CO 80521, or the Loveland Police and Courts Building, at 810 East 10th Street, Loveland, CO 80537.  Filed cases are assigned to all five 8th Judicial District County Court Judges on a rotating basis.  In most cases hearing dates and times are set at the time of filing.  Please inform the clerk when you file your case if you require an interpreter.  Mediation will be required on the day of trial.  If you intend to submit written exhibits in your case, please bring an original (for the Judge) and 2 copies (one for each party) to your court trial.  The originals of any exhibits admitted as evidence will be retained by the Court until any appeal period has lapsed.

9 Garfield / Glenwood Springs .75/form N

The Small Claims Clerk is available Monday - Friday 8:00 a.m. - 5:00 p.m. at (970) 945-5075. Small claims trials are held every Wednesday at 2:00 p.m.

  • Parties will need to provide an original and 2 copies of exhibits for trial.
  • We will not require that the answer be filed before heading into court since the Judge will encourage parties to discuss case before the case is called up for the trial. If an agreement is not reached at that time, the Defendant will need to proceed to the clerk's office to file the answer and pay the filing fee.
  • Any and all correspondence needs to be in writing (i.e. continuances, dismissals etc).

Small Claims trials are scheduled on Monday, Tuesday and Thursday mornings.

  • If the Defendant is contesting the claim, the answer MUST be filed prior to the Court Trial.

  • Mediation is required in cases where mediation was part of a contractual agreement.  The cost is $40.00 per hour.

Small Claims are typically scheduled on Thursday mornings at 8:15 am. Mediation is required on all cases prior to any Court Trial.  All Parties must be prepared to proceed to the Court Trial that day if an agreement is not reached in mediation.

  • If either party believes that the judgment of the court is in error, that party may appeal to the district court by filing a notice of appeal in the county court within 21 days after the date of entry of judgment. All Appeals must have a transcript of the court proceedings and payment is the responsibility of the Appellant.

Small claims cases are accepted Monday-Friday from 8:00 am – 4:00 pm at Montezuma County Court located at 601 N. Mildred Rd. in Cortez. The initial setting for small claims is a mandatory mediation with a local attorney. If the case is not settled, a court trial will be set before the Magistrate. Mediations and court trials are held on Thursdays.
