Local Small Claims Practices

There are some local policies or practices that you should be aware of, in addition to the small claims handbook.  This list may not be an all-inclusive list of requirements you may need for small claims court in your location. You may wish to contact the court you plan to file in to make sure you have all the information you need.

Interpreter Information
Interpreters services are provided by the court for all parties in small claims cases. Please notify the court as soon as possible if you require the services of an interpreter for your hearing, or contact the Managing Interpreter in the district in which your case was filed.

Small claims trials are held on the 2nd and 4th Monday of every month at 8:30 a.m.  Be at least fifteen minutes early to get through security and be on time to court.  Being late may result in a dismissal or a default judgment being entered against you.

All parties will be ordered to mediate on the trial date.  Volunteer attorneys will be present to act as mediators.

If a case is not resolved through mediation, a trial will be held.  Parties are expected to be prepared to present evidence through testimony of themselves, witnesses, or documentation to support their claim or defense.  All parties must read the “small claims handbook” that can be accessed via the link above to ensure they understand how to prepare and present their case.

Requests for a continuance must be in writing and filed before the trial date.  All correspondence to the Court must be copied to the other party and the moving party shall certify that they have done so on the face of the correspondence.

Failure to appear to court on time on the appropriate date may result in a default judgment or a dismissal of the claim absent a showing of good cause.

(970) 252-4300.  Court hours 8:00 - 12:00 and 1:00 - 4:00.  Small claims are held on the 1st, 2nd, and 4th Friday of each month.

  • No fee for the packet.
  • If the Defendant is contesting the claim, we require the answer to be filed prior to the court trial.
  • If parties have written exhibits, we require them to have an original set for the court and a copy for the opposing party ready to go prior to court trial.

8 Ft. Collins / Loveland N/A Y

Larimer County has two locations where Small Claims cases must be filed. One location is the Fort Collins Justice Center,  201 LaPorte Avenue, Fort Collins, CO 80521 and one location is the Loveland Police and Courts Building, 810 East 10th Street, Loveland, CO 80537.

ALL hearings are held in Fort Collins regardless of where the case is filed.

Hearings are held:

 Every Thursday at 8:15am and 1:15pm

 All sessions are currently held at the Fort Collins Judicial Center. Specific dates maybe obtained by contacting the clerk's office at (970)498-6100. Mediation will be required on the day of trial.

9 Garfield / Glenwood Springs .75/form N

The Small Claims Clerk is available Monday - Friday 8:00 a.m. - 5:00 p.m. at (970) 945-5075. Small claims trials are held every Wednesday at 2:00 p.m.

  • Parties will need to provide an original and 2 copies of exhibits for trial.
  • We will not require that the answer be filed before heading into court since the Judge will encourage parties to discuss case before the case is called up for the trial. If an agreement is not reached at that time, the Defendant will need to proceed to the clerk's office to file the answer and pay the filing fee.
  • Any and all correspondence needs to be in writing (i.e. continuances, dismissals etc).

9 Garfield (Associate court in Rifle) .75/form N

A Small Claims Clerk is available Monday - Friday from 8:00 - 12:00 and 1:00 -5:00.  Trials are held on some Tuesdays.

  • Parties must provide copies of exhibits to the opposing party in the case.

Small Claims cases are accepted Monday - Friday 8:00 - 12:00 and 1:00 - 5:00. You can contact the Small Claims Clerk at (970) 925-7635. All small claims cases are heard on Wednesday's.

  • You are responsible for providing copies your exhibits to the other parties.
  • All correspondence should be in writing and parties are encouraged to discuss the case prior to trial.

Small Claims trials are scheduled on Monday, Tuesday and Thursday mornings.

  • If the Defendant is contesting the claim, the answer MUST be filed prior to the Court Trial.
  • Parties are required to file the original return of service with the court on or before the scheduled court date.
  • Exhibits: Original plus two copies are required for trial.
  • Mediation is required in cases where mediation was part of a contractual agreement.  The cost is $40.00 per hour.

  • Initial hearing for small claims is a setting. Parties are to appear with list of exhibits and witnesses at the setting that they intend to present at trial. All cases are referred to a mediator who is present at all hearings.

  • Requests for continuance must be in writing, and must be accompanied by an answer and filing fee. Default judgments and dismissals will be issued 15 minutes after the scheduled court time.
  • If you require them, subpoenas are issued at the main clerk's office.
  • If parties have exhibits they wish to present to the Court, they must bring 2 copies of the exhibits as well as the originals for the Court and mediation.
  • If either party believes that the judgment of the court is in error, that party may appeal to the district court by filing a notice of appeal in the county court within 21 days after the date of entry of judgment. All Appeals must have a transcript of the court proceedings and payment is the responsibility of the Appellant.
